Rather than a general study of Roman slaves’ material culture, the reader will find here an anthropology of the architecture of the spaces and built environments in which slaves dwelt and toiled (5). Thus, the focus is not so much on the material conditions in which slaves lived or the artifacts they worked with, but on the layout of a small set of first century c.e. houses, streets and economic units, mostly found in the Bay of Naples, Ostia, and the ager Cosanus. The study of space serves Joshel and Hackworth Petersen as an attempt to reconstruct slaves’ responses, through adaptation and challenge, to the choreography of movements imposed on them by their masters.Methodologically, this investigation operates on the distinction developed by Michel De Certeau (The Practice of Everyday Life [1988]) between the strategies of the powerful to delimit a space in which power relations can be managed to their own advantage and the tactics of the weak to seize the opportunities to use an imposed spatial order for their own ends (8). The authors see their work as “an act of remembrance” (222). Their aim is to make invisible slaves visible again. Slaves, they contend, have not only been silenced in classical texts written by and from the point of view of slave owners. In the process of collecting and analyzing ancient material, and in the crafting of their historic narratives, modern archaeologists, art historians, and even tourism authorities have “actively, if unwittingly made [slaves] disappear” (3). To redress the imbalance, Joshel and Hackworth Petersen walk away from mere static descriptions of archaeological sites and concentrate on the dynamic of slaves’ movements within those spaces.Although the authors rely on other archaeologists and historians’ fieldwork and interpretation of the material remains, they themselves visited most of the sites and buildings they describe. The book is profusely illustrated with sixteen plates and 170 figures, among which we find the authors’ own photographs of some of the structures they discuss, such as doorways, storage rooms, stairs, porticos, kitchens, street benches, and fountains. Other illustrations consist of maps of Pompeii, Herculaneum, and Ostia (19–21), street plans of Pompeii (plates VI, VII, and XI), and building plans of the houses, workshops and villae dealt with in the body of the text. Constant cross-reference to these images and drawings helps the reader to see and understand space in three dimensions, something [End Page 709] that it is not always easy to elicit from illustrations and archaeological reports in which findings are presented in a two-dimensional plane.The book is divided into six chapters. The Introduction (chap. 1) lays out the aims of the book and the methodological approach chosen by the authors. In the next four chapters, the discussion of built environments moves from the inside to the outside and from an urban set-up to the rural world. Chapter 2 focuses on the architectural layout of houses from Campania and Rome’s port-town, Ostia: namely, the houses of the Menander, Julius Polybius, Sutoria Primigenia, the Smith, Lucretius Fronto, the Ceii, the Vetii, and the Gilded Cupids in Pompeii; the houses of the Corinthian Atrium, the Mosaic Atrium, the Alcove, the Beautiful Courtyard, the Samnite, and the Grand Portal in Herculaneum; and the Ostian house of the Muses.The analysis of the Roman domestic landscape uses Andrew Wallace-Hadrill’s two axes of differentiation between the grand and the humble and the public and the private (Houses and Societies in Pompeii and Herculaneum [1994]:38), but the emphasis is on the slaves’ perspective within this framework, rather than the owners’—even though the latter is not absent. I argue for patternism, a new answer to the question of when some objects compose a whole. None of the standard principles of composition comfortably capture our natural judgments, such as that my cat exists and my table exists, but there is nothing wholly composed of them. Patternism holds, very roughly, that some things compose a whole whenever together they form a “real pattern”. Plausibly we are inclined to acknowledge the existence of my cat and my table but not of (...) their fusion, because the first two have a kind of internal organizational coherence that their putative fusion lacks. Kolmogorov complexity theory supplies the needed rigorous sense of “internal organizational coherence”. (shrink)

On the one hand, the absence of contraction is a safeguard against the logical (property theoretic) paradoxes; but on the other hand, it also disables inductive and recursive definitions, in its most basic form the definition of the series of natural numbers, for instance. The reason for this is simply that the effectiveness of a recursion clause depends on its being available after application, something that is usually assured by contraction. The aim of this article is to provide a systematic reconstruction and critique of what is taken to be a central ethical concern against the use of non-medical egg freezing. The concern can be captured in what we can call the individualisation argument. The argument states, very roughly, that women should not use NMEF as it is an individualistic and morally problematic solution to the social problems that women face, for instance, in the labour market. Instead of allowing or expecting (...) women to deal with them on an individual level, we should address them by challenging the patriarchal structures of the labour market—for example, by securing equal pay, or paid maternal leave, or ‘paid paternal [partner] leave and sick leave and affordable child care’. It will be made clear that there are several versions of this argument. The author will try to elaborate this claim, and it will be explained that the differences depend on the way in which bioethicists believe that individuals use of NMEF is morally problematic, compared with the alternative of securing social change for women in, say, the labour market. Finally, a critical discussion of three versions of the individualisation argument will follow, and it will be shown why all versions are on rather thin ice, or in other words, that they are implausible. The article examines the role of narrative discourse in religious education and communication as represented in Kirsten M. Andersen’s Kantian approach. In Hegel’s Lutheran perspective figurative thinking is deconstructed in forms of interpretive narrative, the topos of the speculative Good Friday. On this account the words of Jesus should be understood as an unprecedented revolutionary parrhesia. Hegel’s pervasive awareness of the linguistic mediation, translation and appropriation anticipates the role of language and communication in hermeneutics and deconstruction. Background Nurses frequently face situations in their daily practice that are ethically difficult to handle and can lead to moral distress. Objective This study aimed to explore the phenomenon of moral distress and describe its work-related predictors and individual consequences for home-care nurses in Germany. Research design A cross-sectional design was employed. The moral distress scale and the COPSOQ III-questionnaire were used within the framework of an online survey conducted among home-care nurses in Germany. Frequency analyses, multiple linear and logistic (...) regressions, and Rasch analyses were performed. Participants and research context The invitation to participate was sent to every German home-care service ( n = 16,608). Ethical considerations The study was approved by the Data Protection Office and Ethics Committee of the German Federal Institute for Occupational Safety and Health. Results A total of 976 home-care nurses participated in this study. Job characteristics, such as high emotional demands, frequent work-life-conflicts, low influence at work, and low social support, were associated with higher disturbance caused by moral distress in home-care nurses. Organizational characteristics of home-care services, such as time margin with patients, predicted moral distress. High disturbance levels due to moral distress predicted higher burnout, worse state of health, and the intention to leave the job and the profession, but did not predict sickness absence. Conclusions To prevent home-care nurses from experiencing severe consequences of moral distress, adequate interventions should be developed. Home-care services ought to consider family friendly shifts, provide social support, such as opportunities for exchange within the team, and facilitate coping with emotional demands. Sufficient time for patient care must be scheduled and short-term takeover of unknown tours should be prevented. There is a need to develop and evaluate additional interventions aimed at reducing moral distress, specifically in the home-care nursing sector. (shrink)

According to the widely endorsed Knowledge Account of Assertion, the epistemic requirements on assertion are captured by the Knowledge Norm of Assertion, which requires speakers only to assert what they know. This paper proposes that in addition to the Knowledge Norm there is also an Epistemic Propositional Certainty Norm of Assertion, which enjoins speakers only to assert p if they believe that p on the basis of evidence which makes p an epistemic propositional certainty. The paper explains how this propositional (...) certainty norm accounts for a range of data related to the practice of assertion and defends the norm against general objections to certainty norms of assertion put forward by Duncan Pritchard, John Turri, and Timothy Williamson, by drawing on linguistic theories about epistemic modals and gradable predicate semantics. Together these considerations show that the prospects of a certainty account of assertion are much more promising than is usually assumed. (shrink)

Several liberal philosophers and penal theorists have argued that the state has a reason to prohibit acts that harm individuals. But what is harm? According to one specification of harm, a person P is harmed by an act (or an event) a iff, as a result of a, P is made worse off in terms of well-being. One central question here involves the baseline against which we assess whether someone is ‘worse off’. In other words, when a person is harmed (...) he is worse off, certainly—but what is worse off a variation from? A central part of the paper critically discusses different answers to this question based on versions of what we can call: the temporal baseline, the baseline from mankind and the counterfactual baseline. Essentially, it will be argued that the counterfactual baseline leaves us with a better understanding of harming than the other baselines discussed. The final part of the paper will describe some of the implications of our investigation for the application and evaluation of the view that harm matters in the justification of which type of acts should be criminalized by the state. The overall conclusion of the paper is that adherents of a view like the harm principle face a dilemma. Either they can accept the counterfactual baseline but then, they can do without the harm principle. Or they can reject the counterfactual baseline—but then they will have to formulate an alternative baseline which, as will be shown in the paper, is no easy task. (shrink)

In this article, we critically discuss different versions of the fairness objection to the legalisation of neuro-doping. According to this objection, legalising neuro-doping will result in some enjoying an unfair advantage over others. Basically, we assess four versions. These focus on: 1) the unequal opportunities of winning for athletes who use neuro-doping and for those who do not; 2) the unfair advantages specifically for wealthy athletes; 3) the unfairness of athletic advantages not derived from athletes’ own training ; and 4) (...) the unfair health care costs imposed on everyone as a result of athletes’ use of neuro-doping. We conclude that none of these versions offer a convincing principled fairness-based objection to legalising neuro-doping. (shrink)

This study identifies the relationship between local stakeholder pressures and Korean foreign subsidiaries’ corporate social responsibility. Analyzing the survey data of 177 Korean foreign subsidiaries yielded two important findings. First, local primary stakeholders have a positive impact on responsive CSR activities, but have no influence on strategic CSR activities. Second, local secondary stakeholders in host countries have a strong influence on both responsive and strategic CSR activities. Secondary stakeholders have more influence on strategic than on responsive CSR activities. This article (...) suggests a change in managerial philosophy toward primary and secondary stakeholders, which may have important implications for multinational enterprises in achieving greater success with the design of their CSR activities. Little is known about the psychological processes that can explain how connectedness to nature evolves. From social psychology, we know that emotions play an essential role when connecting to others. In this article, we argue that social connectedness and connectedness to nature are underpinned by the same emotions. More specifically, we propose that social relational emotions are crucial to understanding the process, how humans connect to nature. Beside other emotions, kama muta (Sanskrit: being moved by love) might play a particular (...) crucial role when connecting to nature. The paper critically discusses the moral view that neurotechnological behavioural treatment for criminal offenders should only be offered if it is in their best interests. First, I show that it is difficult to apply and assess the notion of the offender's best interests unless one has a clear idea of what ‘best interests’ means. Second, I argue that if one accepts that harmful punishment of offenders has a place in the criminal justice system, it seems inconsistent not to accept the (...) practice of offering offenders treatment even when the state will harm them in applying the treatment. Finally, leading penal theories like consequentialists and retributivists would not accept that the offender's best interests, at least in certain situations, impose a necessary condition for the treatment of an offender. This study examined the influence of two organizational context variables, codes of conduct and supervisor advice, on personnel decisions in an experimental simulation. Specifically, we studied personnel evaluations and decisions in a situation where codes of conduct conflict with supervisor advice. Past studies showed that supervisors’ advice to prefer ingroup over outgroup candidates leads to discriminatory personnel selection decisions. We extended this line of research by studying how codes of conduct and code enforcement may reduce this form of discrimination. Eighty (...) German managers evaluated and selected candidates from an applicant pool including Germans (ingroup members) and foreigners (outgroup members). Supervisor advice to prefer ingroup members lowered suitability ratings of outgroup members as well as their chances to be selected for an interview. Ethical codes of conduct referring to equal opportunities limited this form of discrimination, but only when codes were enforced by sanctions and integrated into organizational every-day practice. Intuitions about contextualist cases such as Cohen’s airport case pose a problem for classical anti-skeptical versions of invariantism. Recently, Tim Black, Jessica Brown, and Patrick Rysiew have argued that the classical invariantist can respond by arguing that pragmatic aspects of epistemic discourse are responsible for the relevant problematic intuitions. This paper identifies the mechanisms of conversational implicature and impliciture as the basic sources of hope for this explanatory strategy. It then argues that neither of these sources provides the classical invariantist (...) with a convincing response to the airport case and its analogs. (shrink)

The aim of this paper is to critically discuss the plausibility of legal moralism with an emphasis on some central and recent versions. First, this paper puts forward and defends the thesis that recently developed varieties of legal moralism promoted by Robert P. George, John Kekes and Michael Moore are more plausible than Lord Devlin's traditional account. The main argument for this thesis is that in its more modern versions legal moralism is immune to some of the forceful challenges made (...) to Devlin by Hart, Dworkin and Feinberg among others. Second, however, the paper challenges the new generation of legal moralists and suggests some areas for further development. Although Devlin's position has been scrutinized thoroughly in the literature on the philosophy of law, there has, to my knowledge, been no comparable, systematic critique of these different proponents of legal moralism. The aim of this article is to present and critically discuss a gametheory- based argument in favour of the view that sports organizations ought to ban the use of performance-enhancing drugs in sport. After presenting the argument in detail, I try to show that the argument is not convincing. First, the argument cannot be used to argue in favour of WADA’s (World Anti-Doping Agency) current ban on doping, at least if it rests on the assumption, that doping use is always (...) harmful. However, that in itself may not be a problem for adherents of the argument, and they can and should modify the harm assumption to cover only harmful use of doping. Second, even with this modification, it is argued that the harm assumption is flawed, for example, because it is not obvious why we should accept certain harms in sport but not harm to athletes caused by doping. Third, the argument is also flawed because it entails the non-competitive assumption: if all athletes dope, then no competitive advantages are gained by any athletes assumptions. The noncompetitive assumption is challenged in view of the observations that doping can have some non-competitive advantages and is, so to speak, not only a positional good and because doping, due to unequal responsiveness, can give some highly responsive athletes a competitive advantage over less responsive athletes. Foucault's work has had a profound impact on the medical humanities over the last decade or so. However, most work to date has focused on Foucault's earlier writings rather than his later contributions on the self and governmentality. This article assesses the significance of the concept of governmentality for critical scholarship in the medical humanities, particularly in creating ethical awareness in the field of health care. It examines the context for Foucault's later work, and contributions arising from scholarship building on (...) this work. The governmentality literature, it is argued, raises novel questions about the ways we have come to think about health care in late modern societies. However, there are some limitations with this body of work which have not been fully acknowledged by scholars. The article discusses some of these limitations and offers some suggestions for a fruitful way forward. (shrink)

This article expands upon the notion of ideology as a material phenomenon, usually in the form of institutionalized, taken-for-granted practices. It draws on Herbert Marcuse and related thinkers to conceptualize technological solutions to environmental problems as materialized ideological responses to social-ecological contradictions, which, by concealing these contradictions, reproduce existing social conditions. This article outlines a method of technology assessment as ideology critique that draws attention to: (1) the social determinants of the given technology; (2) whether the technology conceals or masks (...) social-ecological contradictions; (3) whether the technology reproduces existing social conditions; and (4) whether the technology may be used for more rational or emancipatory ends in different social conditions. The examples of solar geoengineering and agricultural biotechnology are examined and it is found that, in each case, these technological solutions conceal social-ecological contradictions and support the current economic system and those benefiting from it, while precluding other alternatives. This article provides a spatial analysis of the conceptual framework of fluid dynamics during the nineteenth century, focusing on the transition from the Euler equation to the Navier–Stokes equation. A dynamic version of Peter Gärdenfors's theory of conceptual spaces is applied which distinguishes changes of five types: addition and deletion of special laws; change of metric; change in importance; change in separability; addition and deletion of dimensions. The case instantiates all types but the deletion of dimensions. We also provide a (...) new view upon limiting case reduction at the conceptual level that clarifies the relation between the predecessor and successor conceptual framework. Naturalism is normally taken to be an ideology, censuring non-naturalistic alternatives. But as many critics have pointed out, this ideological stance looks internally incoherent, since it is not obviously endorsed by naturalistic methods. Naturalists who have addressed this problem universally foreswear the normative component of naturalism by, in effect, giving up science’s exclusive claim to legitimacy. This option makes naturalism into an empty expression of personal preference that can carry no weight in the philosophical or political spheres. In response to (...) this dilemma, I argue that on a popular (but largely unarticulated) construal of naturalism as a commitment to inference to the best explanation, methodological naturalism can be both normative and internally coherent. Through the criminal justice system so-called dangerous offenders are, besides the offence that they are being convicted of and sentenced to, also punished for acts that they have not done but that they are believe to be likely to commit in the future. The aim of this paper is to critically discuss whether some adherents of retributivism give a plausible rationale for punishing offenders more harshly if they, all else being equal, by means of predictions are believed to be more (...) dangerous than other offenders. While consequentialism has no problem, at least in principle, with this use of predictions most retributivists have been opponents of punishing offenders on the basis of predictions. How can an offender deserve to be punished for something that he has not done? But some retributivists like Anthony Duff and Stephen Morse have argued in favor of punishing offenders who are considered to be dangerous in the future more harshly than non-dangerous offenders. After having reconstructed their arguments in detail, it will be argued that both Duff’s and Morse’s attempts to give a retributivistic justification have several shortcomings. (shrink)

The aim of this article is to articulate and critically discuss different answers to the following question: How should decision-makers deal with conflicts that arise when the values usually entailed in ethical guidelines – such as accuracy, privacy, non-discrimination and transparency – for the use of Artificial Intelligence clash with one another? To begin with, I focus on clarifying some of the general advantages of using such guidelines in an ethical analysis of the use of AI. Some disadvantages will also (...) be presented and critically discussed. Second, I will show that we need to distinguish between three kinds of conflict that can exist for ethical guidelines used in the moral assessment of AI. This section will be followed by a critical discussion of different answers to the question of how to handle what we shall call internal and external values conflicts. Finally, I will wrap up with a critical discussion of three different strategies to resolve what is called a ‘genuine value conflict’. These strategies are: the ‘accepting the existence of irresolvable conflict’ view, the ranking view, and value monism. This article defends the ‘accepting the existence of irresolvable conflict’ view. It also argues that even though the ranking view and value monism, from a merely theoretical point of view, are better equipped to solve genuine value conflicts among values in ethical guidelines for artificial intelligence, this is not the case in real-life decision-making. Anatomy texts are seen as authoritative sources for knowledge about natural sex differences. The concepts of a natural, biological sex and of a natural difference are, however, increasingly difficult to sustain. A growing number of scholars have pointed to the fact that `sex' as much as `gender' is a historical and social construction. This article examines how the multiple-edition anatomy textbook, Gray's Anatomy, has portrayed the sexed body and male/female differences during the course of its publication, 1858 to the present, (...) focusing on specific parts of the anatomy, namely the sex organs or `organs of generation', the pelvis, the skull and the brain. An analysis of textual descriptions and graphic illustrations reveals that the male body has been the stable norm or standard against which the female body has been compared and implicitly judged as underdeveloped, weak or faulty. Only rarely has the male body been compared with the female body. Reflecting long-standing views about sexual complementarity and natural differences between men and women, some comparisons emphasize the reproductive functioning of females or imply that females are intellectually inferior. It would appear that the discipline of anatomy has remained largely immune from broader public debates about sexual inequality and gender representations. (shrink)

Due to the difficulties of providing an adequate physicalist solution to the problem of consciousness, recent years have seen explora­tions of different avenues. Among these is the thesis of cosmopsychism, the view that the cosmos as a whole possesses consciousness. However, constitutive cosmopsychism is faced with the difficult problem of de­combination: how to consistently maintain the claim that individual subjects are grounded in one absolute consciousness. This paper sug­gests a solution by outlining a theoretical model of a broadly idealistic and (...) quantitative substance-monistic character. The key idea here is a triadic rather than monistic or dualistic conception of the subject. This conception allows us to affirm that the individual subject exists while simultaneously holding that its substance component is part of the one, undivided substance. This substance is in turn the substantive component of an all-encompassing, absolute subject. Notably, this model avoids the problem of decombination. (shrink)

The aim of this paper is to argue that the utilitarian principle of criminalization is sounder than its poor reputation suggests. The paper begins by describing three possible answers to the research question: To what extent should the consequences of criminalization matter morally in a theory of criminalization? Hereafter I explain why I shall discuss only two of these answers. Then follows a detailed and critical specification of UPC. Furthermore, I will argue why criticisms of UPC made by philosophers such (...) as Douglas Husak and Victor Tadros in their recent work are far from convincing. Finally, I will present a positive reason for accepting UPC as a principle of criminalization, namely: that UPC is consistent with what I call the Counterproductive Criminalization Principle, while non-consequentialist theories of criminalization are not. The aim of this paper is to criticise the well-discussed Principle of Procreative Beneficence (PB) lately refined by Julian Savulescu and Guy Kahane. First, it is argued that advocates of PB leave us with an implausible justification for the moral partiality towards the child (or children) reproducers decide to bring into existence as compared with all other individuals. This is implausible because the reasons given in favour of the partiality of PB, which are based on practical reason and common-sense morality, (...) can just as well be used to guide reproducers to make choices that do not support partiality towards one’s possible children. This seems to be true as least in some situations. Secondly, it is argued that Jakob Elster’s recent critique of PB is problematic, and specifically that a counterexample designed by Elster to criticise PB because of its partiality towards one’s own children misses the target. Finally, a genuine counterexample to PB is developed in order to show that the partiality of PB means it gives the wrong answer in a specific case. (shrink)

In “On Avoiding Deep Dementia,” Norman Cantor astutely notes that, for some individuals, the concept of “protracted maintenance during progressive cognitive dysfunction and helplessness is an intolerably degrading prospect.” This cannot be argued with. Cantor's solution, however—that in the wake of a dementia diagnosis, patients should have the option to direct, in advance, instructions for voluntary stopping of eating and drinking should they develop a state of deep dementia—is more ethically challenging than it may first appear.Respect for autonomy is one (...) of the most fundamental principles of bioethics, and it requires that we allow patients with capacity to refuse life‐sustaining treatment, even when that treatment is something as seemingly innocuous as nutrition and hydration. If a capacitated person uses an advance directive to prospectively refuse artificial nutrition or hydration, then that treatment must be withheld if the person develops dementia and loses the ability or willingness to eat. Cantor is incorrect, however, in suggesting that an advance directive can require that nutrition and hydration be withheld from a patient with dementia who actively requests to eat or drink. Regardless of the language in an advance directive, caregivers cannot be compelled to abandon their duty to attend to the person's human dignity, nor can physicians be compelled to sedate a person with moderate or severe dementia because that person continues to be receptive to eating and drinking.
